I have signed a housing loan agreement with Standard Chartered and used one of their panel lawyers to draw up my S&P. The agreement was signed in June 2009 and as of today, the final loan settlement has not taken place. The reason the lawyers provided to me was because they could not contact Standard Chartered bank and as a result, I am now liable to pay interest on late payment. The lawyer has also threathned that my deposit will be forfeited if I do not pay the interest on late payment.

Clearly from what I can decipher wfrom your posting, there appears to be a conflict of interest in the banks panel lawyer acting for you. The contract can be voided or rescinded for that very same reason. But you need a competent lawyer to do that and thats as rare as hens teeth or a pair of tits on a bull in Malaysia.

i had bad experience in housing loan processing with standard chartered bank (SCB) as well. the number that SCB provided to the lawyer, always on engaged tone, or most of the time no one is answering. SCB will tell u that one process takes about 2-3 days, but it ended up 2-3 weeks. We cannot solely rely on the lawyer, as they will just tell u no one answer the phone, pending for bank, etc. how i settled this was calling the complaint department of SCB n finally get this done.

ask them to provide you all the correspondence letter with the bank. if the fails to act then anything happened to your loan, sue them (you are the one whos paying their fees)

You cannot sue the lawyer. Because there is no lawyer against lawyer. So what u can do is :-

1) Rectify who make a mistake carefully - sometime it happen because the loan cant be release due to documentation either it is come from bank, panel lawyer, SnP Lawyer, Developer, Government or customer.

2) If it happen from your site (bank panel) u just write a letter to that lawyer and inform the bank about their default.

3) If u are not satisfy with any advocate & solicitor in Malaysia, u can direct complaint to Malaysia Bar http://www.malaysianbar.org.my/berita/komen_undang_undang/ and if it involve money loses, u can get from them (indemnity...
