 | guarantor right (modified 0 times) | kumad | |
| Hello there,
I need some advice on question below.
I have a fren who I being a guarantor for some koperasi loan. Last year, he resign and work someplace else. After awhile, I and the others guarantor did some enquiries regarding his loan. But its look like that he do not have any intention to pay the outstanding. We did discussed this with his current employer and being instructed to get legal instruction to deduct his salary for this.
What I like to know is
1. Can I bring this matter to court to have his salary deduct to pay his loan?
2. Will I bear the court fees? or can I make him to pay all this.
3. How long is the process?
4. Is there a procedure on how to make this process?
TQ in advance. | |

| Guarantors have no rights.
Your fren did not promise you that he will pay the loans.
You promised to pay the koperasi if he don't pay.
You will lose if you take this to the courts.
The best option is to settle the loan for him like you promised when you signed the guarantee letter. | |

| Ya I think you have a right if you pay his debt. You can tell to the court that you the one paying his debt since he dosnt want to pay. You have to engage good lawyer to do this job. | |
