Hi,
Can someone share with me, what will happen if i don't appear in Court after received a summon.

My case is that my nego. on installment payback with the bank for CC already done & letter of agreement been issued out by the bank too (during OCT). But still i received a summon from Court (Nov) to request me to attend the court if not it'll be "penghakiman ingkar".

I've called the Bank Officer for clarification, she asked me to ignore the summon & not to attend but i am still worry, she is just an officer but this is court case. What shall i do then? I've called the Bank Legal, their advise is to ask me to inform the Bank to direct them to stop all this. But the Bank Officer said that i haven't done the full settlement, they can't direct the Legal to do so and as long as i make monthly payment based on the letter agreement given, it shall be alright.

Doubtful on whether to attend or ignore. I just don't want to get myself in trouble with the Court case and will this affect my oversea travel in future if i don't attend? (Sorry, i am not knowledgeable on this) the sentence of "penghakiman ingkar" sound scary to me.

U should appear before the Judge and record your attendance. Then when ur case is called then u can explaineed top court that u wish to settle this matter amicably. Then court will gv his opinion first before proceed with an judgement against u..

On one hand is accepting your installment payments, on the other hand the bank is still suing you.

This is like a signing a peace treaty while still fighting battles.

The bank tells you that they will not stop the legal action because you have not paid in full.

You should tell them that you will stop installment payments unless they withdraw the legal action.

Attend court and fight to pressure them to withdraw. Read William Chan's book on how to fight.
