Hi Notalawyer & Boring,

1st currently I had serve the AKPK, 3rd year mthly repayment was RM1500.00, but I can't serve anymore;
2nd I had refinanced my hse loan to my wife, but deed of assignment (thrid party) under both of us;
3rd I had 2nd hse which bought by mother, but hse loan under my name;

I would like to declare bankruptcy myself, my question as below:
1. Could I still need to transfer my hse name to my wife name for security?
2. Could I still need to transfer my mother name to my brother name for security?

Yes.....Kindly transfer all ur property related with ur name to other relatives before u declare for bankrupt. The best transaction is via sales & purchase agreement instruments even though without money involvement except legal (lawyer) fee.

Example (1) in SnP got 10% deposit upon signing the agreement, this 10% is just on paper only.
Example (2) Purchase name Salmah bte Harun while ur name Rozy bte Hasim, People dont know that Salmah is ur mum, aunty or sis in law.

Actually JIM not keen interested to search ur relative or family in DETAILS ( visit ur place, conduct an investigated etc)once u are bankrupt and have a bankruptcy card with JIM, They only concern ur commitment every month that u are agreed to pay to JIM either directly to them or via Standing Instruction.

Dear Boring,

You means maintain my wife name, and ask 3rd party (relative and mum) to purchase my name or portion, right?

Do they (relatives or mum) need to apply loan?
