Govt took kampung people land for rubber plantation estate

Between 2003-2006, government suddenly took over 1000 acres Kampung's land and turned it into a Rubber Plantation Estate (MESEJ) The reason being was for the government to develop it and will be returned back to the people to reduce poverty in the area. For you information those land that was taken is under Native Costumary Rights (NCR) status and already planted with banana, coconut trees and many more by kampung people. There are houses in the area. The people already applied for the land (LA)title since many many years ago, but title never been released, the area fall under NCR status. The land taken away, the people never consulted, and who will benefit from the plantation remains mystery until today. The kampung people are very unhappy, they did some demo, appeal for the government to release it back to the kampung but all were rejected.

They want to take it to the court of law, but there are limitations
1. Engaging a lawyer is costly, the case probably will be in the court for very long long time, paying a lawyer to represent the Kampung people would hurt their pocket.
2. What are the chances of winning and forcing the government to give up the area back to the people.
3. Is it possible the kampung people file the case and represent themselves in the court of law without lawyer?
4. We cannot trust the government promise of giving it back to the people based on previous similar issues involving Sabah Land Development Board (SLDB) who took massive land from the kampung with similar reasons and promises and until never surrender the land back to the kampung people BUT instead sold them to Sime Darby a private company
5. How to file the case, are there a sample of papers we can use?

Please give some opinion in this. Thank you guys.. we really appreciate any inputs for this.

No, because each villager by himself does not have locus standi.
It has to be a lawyer.

Have you talked to PKR or DAP lawyers?

Yes, talked to SAPP Party lawyer but he got so many similar case under his care, his plat is overflowing with this kind of case. DAP/PKR lawyer does not seems interested to get involved. DAP only interested on issues in urban area. Kampung people hopeless now. Need some advices to help them. Please..
