Credit Card Fight with Affin Bank

BACKGROUND:

My age is 57 years old.

Working in a factory in the Product Development Department on yearly contract basis as I missed the official act date for compulsory retirement of age 60 years.

I have 8 children and one passed away in 2007.

Many years ago during difficult time I took 3 credit cards (CIMB Bank, Affin Bank and EON Bank) one after another just to survive and making end meets until I no longer can service.

Got my EPF 2 years ago try to do some business but failed. No attempt to pay debt as it has all accumulated RM12,000 + RM76,000 + RM77,000.

I live in 'rumah teres kos rendah' (RM20,000 price during purchase time in 1990). And own a very old van (1996).

CIMB Bank converted my credit card debt to term loan which I paid installment only half way. The other two banks credit facilities were for RM5,000 and RM8,000 respectively.

I have never pay a single sen then since last default but the harassment from bill collector needless to say.

I can't exactly remember the year I signed for the credit card but the last credit card payment default I am sure has been more 8 years. Have tried looking for documents but to no avail. Only found one letter from bill collector in 2009 requesting for payment.

EVENT:

23/2/2015 I received registered letter of demand from lawyer (Affin bank) at home and at factory office giving 7 days to pay up.

26/3/2015 I received register letter containing writ summon both at office and home.

27/3/2015 I went to court and file 'Memorandum Kehadiran' which I paid RM8 and a computer printed receipt.

4/4/2015 I browse back the summon which I notice a handwritten scribble note of a date 8/4/2015 (2pm).

Thru reading this forum i manage to check court website:

and found this info:

Really need advice how to go about. My only concern on bankruptcy is loosing my only shelter i.e. that is my house.

Should I wait for the official later or how should I attend (procedure) and what do I need to bring for defence.

And you would understand why you do not need to be bankrupted for the bank to "seize" possession of your house and motor vehicle. To make you a bankrupt, the bank has to "share" with all other creditors. If there is a "shortfall" from this sale of this house, and if it exceeds 30K, then the next step is to seek for bankruptcy proceedings since you are still working.

Line of defence..
From my personal opinion, the only thing you can raise is the 6 years limitation period but when you are not clear of when was the last default date, then they may be complications in your defence.

Q's..
I have 8 children and one passed away in 2007.
1/ Male/Female(the deceased), they got any spouse? Have got any dependants(yr grandchildren)? How old when he/she passed away?
2/ The house you are living in now, with your spouse, children, grandchildren?

aff and eo, each have over 70K, famous for their harsh treatment of ex bank customers(Judgement Debtor), may go all out for the house and whatever left of old junks. You have many children, just sell off this van and drive one under your chidren name(I kept changing old junks for the past 12 years, not in my name, solved the insurance coverage issue oso).

Just post contents of the Writ Summons as per my sifu (vkpc) request asap.

Go to the nearest legal aid centre and seek legal advice. Dun say u r working.. Get a file reference number from the LAC first. They would advise you to request for postponement as time is too short.

On the 8th, go to the hearing, ask for postponement and you are looking for lawyers to represent you.

From there you work out your next step..

When attending the court hearing, dressed in your worse clothes but in proper shoes, long pants, no T-shirt, dye your hair more white and look "sick".. Lagi best, go in a wheelchair. Let those young lowyers see the face of the poor old man they are attending court with..

He was my 2nd son age 22 years old ( sudden death-due some form of heart attack of sort). the rest 6 are all daughters.

2/ The house you are living in now, with your spouse, children, grandchildren?

With my spouse and 3 youngest daughter, sometimes grandchildren do come for occasional visit.

@ jeff05.. just sell off this van and drive one under your chidren name.

i dont mind disposing this van ( intent use to ferry children previously. last use of selling clothes during puasa month) . value not much maybe the 5k.

In my mind .. if later bankrupcy i would beg for mercy to JIM to lelong this van instead of the house.

For info my married children are all an everage economically and only self sufficient.

@ Abu Bakar..Get a file reference number from the LAC first.
What is LAC. sorry i do not know the term but i also try to read from previous posting of fellow forumers.

There are 2 active ones now. BCLAC (Bar Council Legal Aid Centre). BBG (Biro Bantuan Guaman). You can get free legal advice from them. If yr salary does not exceed 2.5K, they may offer free representation.

Approach them for free representation, get a reference number from them and then inform the court for postponement for LAC to prepare your file as too short a time now. Whether they represent or you self- represent later is another matter.. Buy time so that you can focus on what you can do next.

There wll be no mercy from the banks that bankrupt you. Nothing to do with JIM. There is no compassion from those mechanical robots. Do make arrangements to sell the house asap if you cannot settle all the debts. Selling it now, you have a very much higher market value, JIM lelong, you may rugi a lot.. Sell for CASH and lower market value and hid the moneys.

However, it may not be so serious if you can fight off this current suit to make you a Judgement Debtor.

Jeff05 i did a frantic search in the house for any document that might be related to the date for limitation period purpose but couldn't find any BUT instead i found the actual physical card mentioning being a member since 2002 and it is good until nov. 2003. I remember that was the last. Will this help?

Thank you very much for this option info i  needed them just as much as i need the our fellow forumers here, as iam  zero knowledge on legal matters furthermore where would i type and print these legal papers to be presented to court.

c) membayar caj bayaran lewat ( Late Payment Charges) pada kadar 1% sebelum untuk setiap kad di atas jumlah yang dihutang atau bayaran minima sebanyak RM5.00 sebulan mengikut mana yang lebih tinggi, tertakluk kepada maksima RM50.00 sebulan.

d) kos guaman (atas asas peguamcara dananakguam) dan lain-lain perbelanjaan yang di tanggung oleh Plaintif dalam menguatkuasakan perjanjian tersebut dan dalam mendapatkan bayaran kepada Plaintif di bawah perjanjian tersebut.

Berikutan dengan penggunaan Kad kredit tersebut , Defendan telah terhutang sebanyak RM7x,xxx.xx setakat 3/3/2015; ( sselepas ini di rujuk sebagai '' hutang tersebut") yang merupakan jumlah perbelanjaan termasuk faedah dan caj terhadap Defendan yang di  kenakan bersesuaian dengan perjanjian tersebut.

Read all posting of "Aurora" xcept the xmas one.. This may/would be what you would be going thru soooonnn...

From 2003 t0 2015 = 12 years
From 5K to 70K based on the Penyataan Tuntutan .. fairly accurate computer generated  statements but bladi blood s_ucking vampires..!! At least 65K interests alone..!!

Fight.. Fight.. Fight.. If not you may loose your only property for old age and at old age..!! You have to be very careful and to attend to ALL court hearings. Do not give a chance for those bank lowyers to sneak and back stab you.!!

If you have dependants, like your deceased son's children staying with you, and they are schooling nearby, JIM may give you more time to reallocate, maybe 1 year, 2 year?? But still you will lose this property under bkcy laws.. This is the bankrupt estate..

Sori bro.. this is life under bkcy..
