| salary after bankruptcy (modified 0 times) | JoSePhInE | |
| Hello,
I would like to ask, after you have been declared and bankrupt and currently working with a monthly salary credited in a bank account, the bank account and salary will be frozen am I right? I may need to get JIM's approval to re-open or open a new bank account for the salary crediting purpose. How long does it usually take for this process to complete? From bank account and salary being frozen -- application for approval from JIM to re-open -- approval granted from JIM.
Thank you. | |

| Hi Josephine,
First thing you have to registered yourself to Jabatan Insolvensi (JIM)- make appointment wt them. They will ask you to fill up a few form and go to commisioner oath. after that It's take less them a week to get a letter to re open or open a new account wt bank. No worry ok.

| Here is my story....found out I was unable to withdraw my salary end of June. Called Tiger bank and they told me that my account has been tagged by HQ and no reason given. Went to insolvency dept in Putrajaya paid RM10 for search. There and behold I am a bankrupt! The next day went to Insolvency KL to report as advised by the Putrajaya staff. There were a number of people waiting for their turn. Everyone who came with or without appointment had to wait reason being the officers are searching for their files. Seems the files are everywhere.
Told my reference number and my assigned officer was on maternity leave. I told them I come from far and dont tell me that I have to wait for the officer to come back from maternity leave. Another officer than reluctantly attended to me. Took my particulars and was asked to come again.
One week later came again unfortunately the officer had an emergency leave. Told them again why cant other officer attend to my case. Reluctantly another officer attended me.
I was asked to fill out some forms and was requested to fill out the declaration documents and income expenses forms. Meanwhile I have submitted two letters address to Pengarah for opening of new account for my salary and for unfreezing the frozen account for my monthly expenses. Both letters were duly acknowledge received. I was asked to come within 21 days to submit all the documents.
On the 15th day after the meeting I went to the dept again since I wanted to know the status of my request to open an account for my salary and the withdrawal from the frozen account for my daily expenses. To my suprise it was not even processed! For this appointment I manage to see the officer who is incharged of my case...at last. She asked me to fill out the declaration form there and then and get the coomissioner of oath to sign and seal only then she can process the application to open the account requested. On the account that have been frozen, she says that she will have to submit to HQ and follow up from them.
I have since opened an account for my salary cheque but yet to received any call on the money frozen.
I think my mistake is not to follow up every now and then with the officer. We want to cooperate but the rate the insovency dept is moving is not helping those who really want to cooperate in settling their debt.
I hope they dont get any bonus this year!

| What I mean is once you bankrap can company bank in directly to your account rather pay by cheque. Is it the procedure. Will the company know that you have been declare as a bancruptcy | |

| Once you have been declared a bankrupt, your bank account will be frozen by the bank which holds your salary. You will need to apply from JIM to reopen or open new account for this purpose. Your company will not know unless if you yourself declare to them or maybe the bank (i'm not sure about the bank). Until JIM approve for your account to be unfrozen, you are not able to withdraw your money. This according to Mr Angry, takes one hell of a time. Like in my case, i have left my bank account empty and i have requested my company to give me cheques from next month on. | |
