Let me share you my personal experience about the process of Borang 1 and 2. Borang 1 is a petition for admission as an Advocates and Solicitors of High Court of Malaya. Borang 2 is your first affidavit declaring the content of Borang 1.
Both Borang 1 and 2 will have to enclose together (1) NRIC, (2) CLP Cert, (3) LLB Cert, (4) Birth Cert, (5) Master profile. All enclosure shall be duly certified. (herein “the set of Document”)
Then, you will file in the set of Document at Counter 1, Bahagian Rayuan dan Kuasa-Kuasa Khas (RKKK) at Level 2 Lobby, Jalan Duta Court Complex (Tips: At the main entrance, go up the big stair case at left hand side, RKKK is on the left nearby. The front officer will check your set of Document and direct you to Level 1(Tips: this is actually the ground floor), Main Lobby, to pay a fee of RM4 so then you can get the Commissioner for Oaths to certify your affidavit. (Tips: prepare exactly RM4, because the cashier will tell you he has got no change etc.)
Thereafter, you will send the set of Document for filing at Level 1 again. If your firm subscribe to e-filing system, then check at www.e-kehakiman.com.my. But if your firm does not have e-filing system, you may do it at the court itself. They will assist you to scan into computer. You will have to pay a prescribed fee of RM98.00 being fees for application for petition (RM80), affidavit (RM8) and Borang 2 (RM10).
Upon filing in the set of Document, you will be notified in 1 or 2 days about your petition number and a sealed copy of it will be given to you. (Tips: a sealed copy simply means the "Kerajaan Malaysia" logo printed on the Borang 1.
From here, you have to make 32 copies of the set of Document for various High Courts in Malaysia and 1 copy for Bar Council Malaysia (Majlis Peguam) and 1 copy for Attorney General Chamber (Pejabat Jabatan Peguam Negara, Putrajaya) and 1 copy for Kuala Lumpur Bar Committee (Tips: Take note that this is as per the place of pupillage. If it is in Selangor, it should be Selangor Bar Committee, if it is in Johore, it should be Johore Bar Committee and so on.) Hence, the total copies are 35 copies x 7 pages = 245 pages (Tips: Make sure the photocopy machine has enough paper, many law firms used to put letter head on the second tray, if the first tray ran out of paper, the machine will take up the second tray!)
If the service is by way of firm dispatch and you do not trust the dispatch, then, you should make additional copy for acknowledgment purpose. Otherwise, you may use the original copy of the set of Document for acknowledgment (endorsement).
Lastly, you have to prepare "Afidavit Penyampaian" to the RKKK. This is to tell the Court that you have duly served all set of Documents to various parties and you pray that you will be given a date of short call.
TAKE NOTE that this is a court process and it is good to pay attention and observation on the process and appreciate the Court system in Malaysia.
