Hi Puan Ira,

I joined a company on 7th August as a Management Trainee and the probation period will be 6 months.

In the Letter of Appoinment, it stated that only upon confirmation, the company will contribute to my EPF & SOCSO as required by law.

My question, is this legal to the employer by not contributing EPF & SOCSO within my confirmation period? Can I request for the EPF&SOCSO contribution from the employer?

Report your case to EPF & SOCSO, and they know their jobs.

Hi LoyerBrook,

Does it mean that it is illegal to do so or what? If it is illegal, I wish to talk my emloyer first before bring this issue to the EPF&SOCSO .

According to the labour law, employer are liable to contribute EPF & Socso for their employee commencing from the day they start working with the company. therefore if your company refuse to contribute EPF for your employment, regardless of whatever reason possible, they had breach the AKTA kumpulan Wang Simpanan Pekerja 1991.

Nevertheless, the company can choose not to contribute for your Socso if your salary already exceed RM 2500.No matter how, i think it'll be a fine move if you talk to your management about the issue before going to the KWSP. no point blowing up the matter. maybe even your management do not notice of the breaching that they had committed.

I disagree with Leader here. You should report the matter to EPF and SOCSO and not to your employer. If you inform your employer then it is likely that you won't pass probation and your employer will never backdate your contributions of both types. Get EPF and SOCSO involved now so that they will ensure not only that you get backdated, but all other employees past and present have their proper adjustments made.
