The company I am attached to has been fully aquired by another MNC company 3 years back. They started the merge begining of this year. Thus, the salary range / increament / sales commission will be fully following the parent company start from end of 2006. This year our company MD told us in this MNC company, sales person are not entitle to any commission. They paid Performance Bonus (max 2 months basic salary this year) should we hit the company assign target. Basically the calculation will be like atated below:-
20% Parent Company Target Achieved, Sales x EBIT
40% Our Company Target Achieved (Combine Sales target for 2 divisions), Sales x EBIT
40% Personal Target Achieved, Sales x EBIT
However, if I achieved my personal assign target (1.5 mils p.a.), I might not entitle to 40% performance bonus if my company not achieved its target and my parent company not achieving their target. This 2 months performance bonus only belongs to me if 3 parties are achieving their numbers.
The official letter for this new shceme only came to all sales person on 21 May 2007. Anyhow, I am achieving my Q1 sales target as what has been assign following the previous offer letter. Thus, am I entitle to claims back my 1% of commission for Q1 legally?
Besides, I found out my parent company is paying 13 months Salary and Performance Bonus (max 2 months basic salary this year) should we hit the company assign target. Furthermore the benefits from my parent company is much more better than what we are entitle in this company. But my company MD said our company is not practise on 13 months salary. How come my company can practise partially scheme (no sales commission) which is different from the parent company?? Furthermore, we still never sign up a new offer letter which is ties to the parent company policy but initially all of us in this company needs to follow the parent company salary and commission scheme. But NEVER follow on benefits part? Is this practise legal?
