Deductions of benefit
Deduction made by employer upon benefits given during resignation

Hi there,

I have been working in a Norwegian oil & gas company based in malaysia for 17 months….
Recently I have tendered in my resignation….
The company has accepted the resignation….
They informed me that they will deduct some benefits provided by the company since I did not fulfill the service for the year….

My company provides RM 1000 as sports benefit for per calendar year….
So I have made this claim in march…its fully paid off already…
But on May I received a good offer and I am moving off to the new company….
So now the company is deducting the RM 1000 from my salary…
I have checked the labour law and this does not fall under any lawfull deduction…
When I asked them they say this falls under industrial act coz my salary is more than 2000….

In my HR policy otherwise….there is a statement saying…

• All employee shall not accrue eligibility for any benefit, rights or privileges beyond the last day worked.

At the same time at the end of this policy it also written

• ALL policies are subject to local laws where we operate in

Which category do I fall into now??industrial or labour??
Can my company make this sort of deduction???

Please advise…
