| Dear All,
I have a friend who is earning a salary of RM2200 per month but on the letter of appointment is stated as non Executive position. When she started working about 2 years ago. she was allowed to claim overtime when working on offdays, rest days and public holidays. Now, she is not allowed to claim some of these benefits because the HR Manager says that she is earning more than RM2000 and is therefore now an executive. Can the HR Manager, change the position or title of the person as she likes?

My opinion would be to refer back to the policy. If the practice has been that she is allowed to make claim for overtime despite her salary of above RM1.5k and there has been no communication of such change (above RM1.5k is not eligible for OT), then she should be allowed to make OT claim. The existing benefit that she had enjoyed prior to this should be continuous unless there has been a communication on this change. If there is no communication/change to the current practice, they it can be debated that this is an existing benefit and the company has been paying her for such claim. - Ms HR - | |

Would like to seek expert's advice whether we can check with KWSP is the new company( going to join ) is contributing the EPF promptly ?
