contract vs labour law

ok im currently in an argument with my boss
i kept advising not to give less leaves than the labour law requirements else it will find us trouble
my boss just got ####ed off and said the employee will read through the agreement and upon signing he agrees to accept the leaves offered

for example

In Malaysia the labour law states the employee for less than 2 years of service to the company entitles 8 days leave per year

so what if now the employment contract says we only offer 5 days of leave
and the employee has signed for it

if lets say he goes to the court for because we didn't give the minimum leaves required by law. who wins?

Your company may or may not win, depending how things are situated

However no matter who wins the court case, once the court take notifies that your company has breached the labour law's minimum requirement, they will sue,fine,terminate the license of your company depending how serious your company is breaching the labour law

Besides, your contract should have been drafted according to the labour law, else why would the labour law even exist?
