I divorce in year 2005 in a joint petition of which the father of my children agree to pay children maintenance of RM750 per month. He has not pay any maintenance for the past 7 months. Upon demand, he claim that he suffer a minor stroke end of last year and at the moment on medication which cost him RM200. He also claim that he has no intention of further paying as he has a new family to bear. He also claim that I am capable of providing for both kids and is legally binding for him to stop paying the maintenance.

Under such circumstances, I need to know my rights. Please advice.

Is it true that if I earn more then him, he should have the rights not to pay the maintenance that earlier agreed upon.

Is it true that if he suffer a minor stroke and recover and still drawing a salary, do not have to pay the children maintenance.

Is it true that upon remarried and having a new family to bear, will lead to my children no longer entitle to the children maintenance.

Can he reappeal to lower the amount

What can I do to make him pay for the outstanding? Do I have the rights in claiming all outstanding amount?

Please help!
