hi there,

me and my fiancee were suppose to get married middle of this year.we have a daughter who is 2 years++ right now whom has been taken care by my fiancee's mom and me. i found out that she is having an affair with another guy arnd middle of last year. I've explained the situation regarding the child future so she left communication with him.however couple months back she started to have communication again and i have proof(etc photographs)showing that they were intimate. She look after our daughter whenever she has mood but i am there for my daughter all the time..she is working and so do i and both have a stable income.I understand that i fight for custody lawfully she will win for sure since she is the mother and my child is younger than 12 years old. Is there anyway lawfully i can get any chance of dividing the time that we can have our daughter? because for sure she will moving with her affair if she gets my child which im afraid will ruin my child cause my fiancee is just 23 years old and she sees for her life now then my daughter.but help!!

Why want to divorce?
If you have affair also she wont divorce you.
Stay together for your daugther.

Ask a girl to call the boy many times so she will get angry with him and come home.

well the sad part is..
the affair of her's claims that he will look after my daughter where i know that he just wants my fiancee to beleive his word so he can use her since she is earning good..
she's blinded by that but my concern is more ont he part of my daugher where if she moves with her she'll go trough hell..n yea i am staying toghther for my daugther and i am willing to as long she gives up her affair which she's not..

Let me get the facts straight.

1. you're not married to her
2. no marriage has been registered
3. both of you Malaysian
4. she is young and having an affair
5. she wants to be carefree and is happy you're taking care of the baby

Correct?

First of, your child is illegitimate child, mother has natural custody and guardianship so basically as a father you're pretty much screwed on this. I hope she doesn't know and doesn't care. Assuming she doesn't care at all, advantage is to you. File a guardianship application with her giving her support to your application and quickly get guardianship of your child and such confirm the custody with you. Only with her consent you can do this. That way you are now the legal guardian of the child and she has given away her rights. Or alternatively I have read about fathers adopting illegitimate children, again with the natural mother's consent. The point of this exercise is to first give you the legal right to have custody over the child, then to decide for the child and finally to shut her out although you are obliged to give her access to the child unless child is adopted.

If she doesn't agree I am afraid yours is a lost cause. You can try to just file into court but your application will not be entertained.
