I am a landlord and rented out the premise , my tenant refused to leave the premises and owing rental plus the power/water supply bill. Can i file a police report and what would be the charge against the tenant in this situation?

Since he has not paid the utility bills, you can cut off electricity & water supply to the premises. Aplly for a eviction order from the court.

i face the similair problem also. tenant refused to pay the rental for 3 month, water bill also never pay but the apartment management can't do anything ? i ask them to cut the water , the management want me to pay RM50 to cut the water and another 50 for connect back.

How to apply for that eviction order from court ? what is the fees and how long the process ?

i already cut the water supply but he still refuse to pay, if i want to lock my premise, do i need to log a police report ? i hear this suggestion from some of my friend.

appreciate someone here can help ! Thanks in advance.

i too faced similar prob a year ago,i gave him chances to moved out due to im don't live at that certain state,i went flew over a couple of times,that particular shoplot was always closed,one time they were at the premises i went in there smiling asking them when will they moved,they gave me all kinds of excuses,thinking i couldnt take it no more....i ask them to leave i just change all the locks n locked the whole shop with their belongings inside.i guess that's the only way to make them to move.imagine i tahan for 3 years..being a nice landlord...sometimes going hostile is the only way to show them whoose boss

This is civil case not criminal case...the police station will not attained ur lodge except the tenant threaten u.

So, what u can do just give a notice with reasonable days to quit (1st, 2nd and 3rd reminder) to them. Then ask your lawyer to take legal action against them. Dont worry all expenses will born by defendant if u win or get court order "PERINTAH KELUAR"...

Note : make sure your tenancy agreement is stamped and if u forget stamped it before, stamp now with Land Revenue Department and pay the penalty....

If my tenant do not pay for the utility bill for more than 3 months, can I ask them to leave my house. They always give excuse for late payment on rental as well. When we sign contract, there is a clause mention that
"If the said rent or any part thereof or any payment payable to the landlord as stated in this agreement shall be unpaid for 14 days after becoming payable (whether the same shall have been formally demanded or not) or if any of the agreements or covenants herein expressed and on the part of the tenant to be performed or observed or if the tenant shall become bankrupt or wound-up, whether compulsory or voluntarily, or enter into any arrangement or composition with its creditors or suffer any distress or execution to be levied on goods then and in any of the said cases it shall be lawful for the landlord at anytime thereafter to re-enter upon the premises or any part thereof in the name of the whole and thereupon this tenancy shall absolutely determine but without prejudice to the rights of action of the landlord in respect of any antecedent breach of the agreement on the part of the tenant herein contained."

Hence, i can ask them to move out from my premise if they didnt pay either the rental or utility bill, right?

last time im so stupid rented my house to a property negotiator tenant that he said he do the tenancy agreement and do stamping for me, after 6months i still not receive the tenancy agreement that i already signed from him ,ask many times but he also said haven't stamping,because im now working at other state, seldom come back to KL, firstly he did pay the rental every month, but now, 3 months i haven't receive the rental and somemore ask to repair the house for him, if on this situation, i ask him to move out but he refuse, what can i do without tenancy agreement? can i report to police? cam i hire lawyer to sue him? or i can cut the water and electricity or change the lock?
hope someone can give me advise, many thanks and appreciate
