I received a letter dated 16th August 2010 from AIA stated that I did not make the payment for my monthly premium that was due on 10th June 2010., I did make the payment on time to this agent every month. As a supporting I keep the bank transaction record of monthly payment that I’ve made directly to her personal account. Since day one I signed for this insurance, she promised and guaranteed that she will help me to make the payment promptly every month to my insurance account and this is not the first time she did not bank in the payment on behalf. Previously, I did receive same kind of letter and I’ve confronted her over the late payment issue. She said that I did not pay her any single cent and that is why she didn’t help me to pay. But when I showed her the bank transaction record she finally admitted it was her fault.

I thought she will be doing her right job after the confrontation, but she DID NOT. The same thing happens again and my patience to liaise with her is running thin. For each late payment there will be 7% interest incurred and I need to bear the cost.

I have write in my complaint to AIA and request to change the agent, but AIA seems like trying to push the ball around and dragging my case.

My questions are:
1. What is the next action that I could take? Can I complain to Bank Negara?
2. Can I lodge a police report or to sue the agent? How much the lawyer fees like?

Is your policy still enforce now?? If No then you better find a better agent to get another policy. It is important to have one. Don't let down by this bad agent.

Yes, you can make a complaint to Bank Negara. Even go to media to give insurance company some pressure. Give all this bad agents a lesson. Also do not allow the insurance company to protect bad agents for business without caring their responsibility toward customers.

About the sue case, you need a professional lawyer for advise.

Why do you have to bank in the cash money to the agent account? You can actually direct the payment to the Insurance company.

It was a mutual agreement between you and the agent, therefore, there is nothing much the company can do unless you lodge a police report and let the authority carry out their investigation. The agent can be terminated if he/she if proof liable.

Bearing in mind that you must have concrete evidence to report the wrong doing of the agent, otherwise the agent may counter sue you for defimation.
