| DEAR SIR, I'M A SENIOR MALAYSIAN ARMY OFFICER. MY CAR INVOLVED IN AN ACCIDENT DUE TO NEGLIGENCE OF OTHER PARTY(LADY DRIVER HIT MY CAR). HENCE MY CAR WAS SEND TO WORKSHOP FOR REPAIR WHICH TOOK 28 DAYS. ON COMPLETE OF REPAIR, I WAS INSTRUCTED COLLECT MY CAR. I ALSO BEEN ASK TO SIGN A LETTER CLAIMING FOR LOSS OF USED OF VEHICLE DUE TO NEGLIGENCE OF THIRD PARTY GIVEN ( RM 40.00 X 28 DAYS = RM 1120.00. THE WORKSHOP SUBMITTED MY CLAIM TO A PARTICULAR INSURANCE COY. IT WAS VERY FINE AND GOOD ONE OF THE CLARKE WHOM REALLY ENTERTAIN MY CALLS AND COOPERATED WELL ALSO ACTED FAST. LOSS OF USED OF VEHICLE DUE TO NEGLIGENCE OF THIRD PARTY WHICH WAS OFFER TO ME AFTER CONSIDERING (ACTUAL REPAIR TIME) RM 40.00 X 5 DAYS = RM 200.00. IS IT FAIR. WHAT WILL HAPPEN TO THE OTHER 23 DAYS. I AS SENIOR OFFICER GOT TO MOVE. WHOM WILL PAY. WHEN ASK WORKSHOP WAS TOLD THAT IS THE PROCEDURE(YES THE WORKSHOP WILL GAIN TALK ABOUT PROCEDURE). I SINCERELY SEEK ADVICE FROM YOU SIR. | |

Usually the loss of used is calculated base on the days require to repair the car by the workshop. In your case, it mean that the workshop only take 5 working days to repair your car. You may send in your car to the workshop for 28 days but that does not mean the actual day of use.
For example, if I brough a car and they don't have spare parts in Malaysia. I have to order the spare parts from oversea and the shipment will only come after 6 months. That does not mean I can claim loss of used for 6 months.
Therefore, it is very important to have a very good workshop that can do the repair job nicely and fast. But sad to say that there are not many such workshop around. | |
