| Last month I was involved in a car accident. Both parties agreed to make a poice report and make an insurance claim to repair the car. I was the innocent party and I suppose to claim other party's insurance to repair my car. When I collect my police report yesterday I was supprise that the police did not issue any summon to the other party eventhough he admitted that he was at fault in his police report. The police also issued a Refer To Insurance (RTI) form the other party. When I seek clarification from the police, they said that the accident was happened in a private road therefore I need to refer to the magistrate in order to claim.
In fact I have already get my car repaired and b4 that the workshop had engaged an adjuster to come out with a report for the insurance claim.
What should I do now ? Should I look for a lawyer to file a civil case ? And how much will normally cost ? Who suppose to pay for the legal fees ?
Pls advice.

Do not panic. all is not lost. You should have reported the matter to the other person's insurance company before repairing your car.
Hopefully the other party has reported the accident to the insurer.
You don't need a lawyer at this stage.That's the last thing you should do.

| From what I know the chances of claiming in this type of cases is not very high and I have spoken to the other party but he refuses to pay me. | |

| HI, i had a similar accident and the lorry reversed into my car and now the police issued a RTI. I called the lorry company and they said they have done all and cannot do anything else and will not pay me.
What can i do in this case ? I do not want to lose my NCD etc as it was not my fault. HOpe you can advise me on this matter.

| Hi,
I am in a similar situation following an accident in a hospital compound. Despite the other party being clearly at fault, the police's ruling was "RTI". Now I am being told by the workshop to either claim from my own insurance (Silly with an NCD of 55%), or alternatively to do a third party claim with the help of a lawyer. The workshop has told me that they would hire a lawyer on my behalf whose fees would be 10% of the approved amount, and they would subsequently mark up the repair quotation to be submitted to the insurance company so that I would be able to recover these fees paid.
I am having my doubts as it all sounds like a good way to scam the insurance company with the workshop and lawyer making a fair bit of money, while I will be required to pay upfront -probably a ridiculously inflated amount- for the repairs with NO guarantees whatsoever that I will even be reimbursed! | |
