Hi,

I myself with 2 partners having intention to import hair care products from UK and sell it in Malaysia. But the manufacturer in UK stating some clauses below in our agreement and contract since we will be their wholeseller here in Malaysia.

The Clause:
14. INSURANCE

Wholeseller agrees to maintain product liability insurance in an amount not less than One hundred thousand dollars US ($100,000), to have ABC PTY LTD named as an additional insured under Wholeseller’s policy, and to furnish a certificate evidencing that the insurance described herein has been obtained and is in full force and effect.

My question is :
1) The company herein call ABC PTY LTD was purchased the product liability insurance under their MASTER POLICY in which is covered globally, therefore in this regards shall we purchase it again just for our Malaysia market here ?
2) If there is any claims filed against us from consumer by using the ABC PTY LTD's products in Malaysia, what is the consequences that :
a) If we purchase our own Product Liability Insurance ?
b) If we DO NOT purchase our own Product Liability Insurance ?

Most U.K. Products Liability policies cover injury or damage caused by goods sold worldwide but only if the goods were supplied by the policyholder's U.K. offices. Goods supplied by the policyholder's overseas wholesalers and branches must be insured by insurers in the countries in which such overseas wholesalers and branches reside.
Your local Products Liability policy will protect you if there is a claim made in respect of goods supplied by you. If you do not have a local policy, you yourself will have to bear pay the claim and seek recourse from the manufacturer.
