hit by a trailer

my car was hit at the back by a truck trailer (which ferrying proton cars) nearby a traffic light where the trailer tried to cut into my lane. I have lodged a polic report on this issue, surprisngly, both my insurance agent (MISC) and it's appointed workshop informed me that usually it is very hard to get an insurance claim from this type of vehicle (trailer, taxi, truck) and I might end up using my policy to make the claim for repair and this will surely impact my NCB, alternately I may have to hire a lawyer to bring the issue up to a court settlement which obviously will take a long time. Is that true? what can I do as a victim, other than to food the bill myself as the last resort.
