Sue Insurance Agent?
Insurance Lapsed Coz Agent Didint Pay Premium - Can i sue the Agent?

To make a long story short, let me summerize things up:

1) I wanted to change my Life Insurance from quaterly to monthly. Contacted the agent, but she was on holiday.
2) Finally managed to meet with her on 26th. My policy was already due (2hb), but still in the 30 days grace period.
3) She mentioned that if want to change mode of payment, have to do it one month in advance from due date. Because i cant afford to pay the quaterly premium (About rm800++) she agreed to pay first for me, then i pay her back in monthly installment. Paid rm250 (cash) on the spot, for the first month payment that i should owe her.
4) 16th next month. Contacted her again regarding the second month payment. Banked in her account rm300
5) 24th. Got letter from insurance company. Found out that my policy already lapsed. Called the agent. She said everything is ok, she will pay it that evening.
6) Few weeks after that, i was hospitalized for heart problem.
7) Claimed from insurance company. Rejected coz symptoms was less then 30 days waiting period (from date of revival).

My questions are:
1) Do i have a case here to sue this agent in court?
2) How much does a court case roughly cost? The amount insured was rm400,000 and was quite substantial. Due to the agent's negliance, my claim was rejected by the insurer. Should i sue the agent and ask her to also pay the legal action cost too?
3) Assuming i do have a case here, should i sue her? I dont think she has rm400,000 to pay the amount that i should have gotten from the insurer. If i won, maybe the agent will be declared bancrupt and i wont actually get anything? However, very "sakit hati" la with these few irresponsible agent, cousing us customer to bear the consequences. Feel that they should bear the consequences. If not, they'll continue doing this to other people...

You shall sue her. Insurance Agent shall makesure all our right being protected since he/she is making their life thru commission incurred on policy that we purchase. If they not guide us or lead us properly. I would said better then we use all the money go to gamble as we still can see the result instantly rather then wait till issue happen then being informed we are too late or not entitle for this and that..bt then why they oollect if in the first place if we are not able to claim it. All this Insurance Agent shall be the one to be questioning. Kalau tidak. i dun know what is the reason we shall paid agent with such ahigh commission until one of my uncle can getting 60,000.00 a months for just selling insurance policy.

You could have her license revoked. It seems to me as if she was trying to steal your money, leading you to lose your coverage.

Yes, you should sue the agent. Even I am an agent too but i fully support you. This kind of agent make all the good agents shame an make our life difficult. Should give all the bad agents a lesson. Better is go to media to give them and insurance company some pressure. Rather then the company protect their agents without responsibility.
