IPCM has a branch in Kuala Lumpur and one each in Sabah and Sarawak. While you can file your application directly without obtaining any professional assistance, you are advised to file your application via a patent agent or IP lawyer even though more costly.

There are lots of requirments, procedures, and forms. Patent agents can give you professional opinion as to whether your invention is generally patentable and any point in continuing with a patent application. Most importantly, they have the skills to have the description drafted broadly well enough to ensure that potential infringers cannot get around it.

It may take up to 7 years for the patent to be granted and it's going to be quite costly. You should conduct a cost-benefit analysis to determine if it's worth it. The for the entire life of the patent can cost tens of thousands to millions. The term of patent is 20 years from the date of application, subject to payment of annual fee starting from RM200 - RM2000.

Just like to share some facts and figures from the newspaper yesterday during the launch of the National Intellectual Property Day 2007:

It was quoted that the government would like to "help lower the cost of patent registration, which sometimes can be up to RM40,000". This means a person can apply for patent for less than RM40,000.

In addition, the Prime Minister mentioned that the time taken to obtain a patent for an innovation is too long (seven years), which by the time the patent is acquired the invention would be outdated. The current average time to acquire a patent for an invention in Malaysia is 4-5 years, while the international standard took 3 1/2 years.

Since 1986, 87,846 applications for patent were received by the IPC Malaysia. However, only 29,432 or 33.5% were approved. From that, less than 20% of the application came from Malaysia.
