Divorce Procedures
How to go about in divorce for marriage least than 2 years

New MessageDivorce Procedures (modified 0 times) Golddy
I have been married for 1 year now. My husband is having a severe drinking problem. Whenever he is drunk he will humiliate me in public. This got worst as drinking heavily results financial problem became a burden when he starts not to support me in household budget. It's more dissapointed when i found out that he flirts around in his office with his collegues. I found out thru sms that he gave to various women (the content was very much clear of his intention of dating those women out)He gambles very often as well. I have told him that i wanted a divorce but he refuse to do so. I would like to know whether i could file a divorce on my own when my marriage is least than 2 years. Would it be more faster if both agree to sign the papers in this case?

Before petition divorce at court, forward to JPN mediation discuss on your family problem with both part attending as well,
If problem can't be solve ,Dept.will issue a cert.for petition divorce,
If can't pay on divorce petition fees, kindly goes to Biro Bantuan Penguam in the state nearest to you,
If income less than RM2000.00 monthly can be request on FREE service,
If income RM2000.00 above can request on partly payment, cause they are under M'sia goverment service,(you are M'sian)
So save some money for your diovrce live style or your children,.,.

Under Malaysian law, you cannot petition for divorce (whether on your own or by way of joint petition), if your marriage (registration) is for a period less than 2 years. There are exceptions, and you can apply for dispensation of this 2 year period, but my experience is that by the time the application for dispensation is heard and an order given - the 2 years are up. So might as well wait it out.

An option is to live separately for the waiting period then file as soon as time frame is up.

It is faster to apply for divorce by way of joint petition (i.e. both of you agree and sign) - in my experience, it takes about 6 to 8 months in kl courts (from the time everyone signs the papers).
