I once read a topic which has similar case as yours.
The book warned about it.
Try to shop for it in MPH

Hi phil_ab,

Why bother so much about Income Tax problem, after you had been taxed?

To get out of the country or come visit or work again is none of Income Tax Department's business, if you had paid your tax while working there.

You went to the wrong Department. You should go to Immigration Department, if you are talking about "Stay".

Illegal Immigrants from Philippines and Indonesia get in and out of East Malaysia Freely at anytime they like without paying tax.

So think of it as a silly joke if you are social-responsible enough to "Beg" the Inland Revenue Department to Tax You!

hi,

I think your accountant was right, foreign income is not taxable. It was assumed you have paid the tax in your foreign part of country.

Malaysia company tax rate is 27%, look for off shore country which is 'Zero" % tax(eg Labaun), then you may be not liable to declare any tax in Malaysia, since off shore country have cheaper rate of tax or zero tax and you have declared over there.

Tax evation is a an offence.

Hello

i know there's alot of confusion here. You may wish to speak to an officer in Bahagian Teknikal of IRB and get the clarification straight.

Basically, in the absence of a permanent esablishment in the UK, the IRB may view that this income is derived from Malaysia and hence subject to tax in Malaysia. I believe u do not conclude sales etc in the UK? if you are not taxable in the UK then i would think the IRB may tax that income inMalaysia.

But then again, calling Bahagian Teknikal and get it cleared is the best. You may wish to even write in to them and tell them the entire situation (you can write in english la!)...it will probably take them 2-3 months to revert with a written clarifications. SO written is better than verbal right?

First thing first...call the IRB Bahagian Teknikal. General line is 03-6209 1000. good luck

Under double tax treaty, tax had been paid in UK will not be taxed in Malaysia and vice versa. "commission" is part of Income in the interpretation of IRB therefore you have to declare the income. Foreign source income remitted to Malaysia will not be taxed if you have already paid tax in overseas.

Wow! Great discussion here.
I've been searching for answers for long time over the internet too. Couldn't find any. I am a Malaysian earning affiliate commission and ad sales from the U.S. for the past few years. About few years ago, I wrote to IRB (email) and receive no reply. I called them and they cannot give me a direct answer - They answered kalau, kalau, kalau ... even after I've told them my actual situation. It's really frustrating. I did once told myself out of anger that no answer from IRB means no tax payment but in the end I did submit my Form B while lots of my friends do not. Anywhere, thanks for all the great info too.

Did you try to call jcboy? I don't think my situation is the same as yours since I did set up a company (sole prop) to run the internet business. I can deduct office rental, electricity, server/hosting, advertising, telephone and internet/broadband and etc. charges. In the Form B, there is also a Pelepasan in Bahagian D of RM8,000 (automatic). I fill in the amount earn from the affiliate programs in C1 and all business deductions in M16 and M23 and deduct the pelepasan/rebate. It's that simple.

Yours is most probably a home-based sort of business. I am not sure if there are any rules or laws governing home-based business in Malaysia. Home-based business comes with it's own issue - deductions. In my opinion, in order to qualify as a home office deduction, you must first prove that the home office is a qualifying home office. You should have a phone line or internet account exclusively for home business use to qualify for deduction, you better confirm with IRB Lots of deductions are abused deductions. In the US for example, first home phone line is not a permissible deduction. I am not aware of such rule in Malaysia.

Hi Bonuslinking,

By the way, it doesn't matter how you withdraw the money. It is how much money is deposited into your account, be it via telegraphic transfer/wire or U.S. checks deposited into your account in Malaysia.

hi there,
i have a question regarding this topic as well.
for me, i have been employed by a singaporean company, with my pay being paid into a singaporean bank account.
i will be based in malaysia, servicing my employer's customers in malaysia and this region.
i will definitely be here for more then the 60 days limit.
from singapore's tax department's perspective, i will need to pay tax in singapore as my employer is a singaporean company.
what about malaysia's perspective? will i get taxed?
