Rental deposit issue

Recenly I have a case where my landlord holding and drag to pay back my rental deposit. Do I have right to hold the key until they refund me the deposit? For your info, the notice already given and agree by the owner (property management firm) 3 months ago.

Hope to hear from you soon as they threat me that if I am not giving back the key it's consider I am still renting. Do they have right to do so?

You should return the keys.

Tell them that if they don't return the deposit within 14 days, you will summon them to
Consumers Tribunal in Putrajaya.

If your case is straight forward, it is easy to win there.

I have already return the key actually but now they start to charge me for the air cond servicing and to repaint for the room. THe house is sooooo old and the air cond is sooooo lousy since the very first day and they dare to mention that I am the one who mess up the place.

If really go to the Consumeners Tribunal? What shall I do?

Tell them that normal wear and tear through normal usage cannot be used to deduct the deposit.
However, if you sprayed graffiti on the wall ( for example ) then, such damage is not normal usage and can be deducted from the deposit.

When you go to Consumers Tribunal in Putrajaya, pay RM15 and fill up the forms.
The counter people will advise you on the procedure.
Give one copy to the landlord, ask him to sign your copy as acknowledgment of the summons.
If the landlord does not want to go to Putrajaya, he may return your deposit in full.

On the day of the hearing, you and the landlord just argue there in front
of the President of the Tribunal like pasar malam.
No lawyers are allowed at the tribunal.
