"Tanah Mendap"

Hi,

I need some advise. Our housing area is facing "tanah mendap" problem. The walls and tiles at the car porch is breaking and after an incident the developer did some investigation they are giving us option to move out temporarily until they repair or sell the house to them at market value.

As it is a fast developing and prime area, we do not want to sell the house and furthermore most of the residents unable to buy a new house as other houses in that vicinity is high and most of the residents are retired or cant afford the loan.

How to we demand for the house to be rebuilt and how can we get compensation for the renovation work done, damages and all the hassle we have to go through. Furthermore, the developer is taking so much time and we do not see any seriousness from their side. I contacted the Kementerian Perumahan (tribunal) but they said our case would only be valid for new housing development (max 2 years) and this house is about 5 years old.

Please advise how we can solve this matter as soon as possible. Thank you.

invite them for a formal and peaceful negotiation using a third party to facilitate. When a decision is made, bind it using a settlement agreement. It is part of a process called mediation and you could ask for some free advice at 0322890775. With that settlement agreement, if you want, approach Kementerian or the courts and file it. That assures that the developer sticks to the plan. Plus, the process is a quiet, fair process and it focuses on a win win setting. From the looks of it, the developer is already open for discussions but have it it done properly. Through this process, both parties get a chance to tell their side of the story without bad blood . On the developer's side, this doesn't get to public.
