Claim 3rd party car insurrance

Hi Sir,

My car was bang 2 days ago and polis report was made.
No summon is given to me due to it's 3rd party fault.

May i know can i still able to claim his car insurrance as he don't want to report.
If yes, by how?
If not, can i charge/sue the car owner?
