My hubby had resigned from A company since 15 November 2012 but his company still hold his half-month salary until now.

My hubby is a foreign husband permitted to work in Malaysia. He also applied work approval from immigration for working at A company. Now the company hold his salary because he did not cancel the work permit.
I would like to know whether this is legal action to hold back employee's salary?

Hope for your advice. Thank you.

They can't hold back his salary. If his salary is not more than RM 5,000, he can go to the Labour Court to lodge a complaint to get his salary back.

if you:
1. know exactly what you'd do if they still ignore paying you. ie: you'd sue them, take them to court or you'd like to tarnish their reputation, THEN THERE IS A DISPUTE

when there is  a dispute, then make it known to them. give them ultimatums. give them a deadline. If they do not comply, the you have 2 choices.
1. appoint a lawyer and go to court
2. appoint a mediator and settle it out of court.

for mediation services. there is one person that you can contact for free advice. do contact 0322890775 or mediationmalaysia@gmail.com
