Dear Sir,

I had an accident in Oct 2010. Summon given to me and i obey to the decision despite arguments. I claim my Toyoto vios damages and inform Etiqa abt it.

I march 2011 i received a lawyer letter stating that i need to inform my insurance abt the accident and  allow 3rd party claim or else will be sued. I confuse yet make calls to many places and finally they told me the letter is common and just ignore it only.

The laywer firm whom issued the letter, toyota officer and etiqa officer told me the same statement. That it is common procedure and to ignore it. I did.

but now in Sept 2011. Out of sudden the same lawyer firm sent me a summon and statement of claim to me  I need to attend the court hearing on 18/10/2011 seems. I'm so confuse. I have purchased 3rd party insurance and suppose they can claim my insurance without problem right ?

Wht they need to summon me ? I called the same lawyer firm and so weird they ask me to ignore all letters from them again! They said i no need to attend to court on the day as well. How can i trust them ? What should i do Now ? Pls help.

Don't trust these vultures.
Call your insurance again and ask whether they are going to attend the court together with you.
Attend the court on that date and ask for 1 month time to "find a lawyer".

It could be that your insurance is refusing to pay them, so now they sue you.

I supposed you have a comprehensive insurance cover with Etiqa, meaning you had successfully claimed for the damages to your vehicle, a Vios and obviously Etiqa was already notified of the claim including a third party insurance claim against your policy. This happened back in Oct 2010.

In March 2011 on receiving the third party's legal letter you should have passed it to your Etiqa and request them to tell you exactly what to do, and what they are exactly doing. But you had failed to do so....

In Sept 2011 you received a summon and you are still not doing anything concrete! Please wake up and immediately contact Etiqa and work on what's next steps to take. This summon came simply because Etiqa failed to respond positively to the third party claim made. And you have every rights to know why!

Either you go immediately to Etiqa to resolve the matters or you would be in a mess by the end of October 2011!
