A good friend of mine had given up his Malaysian citizenship and has become Singaporean. But he was declared bankrupt in 2006 after he has given up his citizenship. Few months back, I helped him to check Jabatan Insolvensi Malaysia (JIM) and he was confirmed declared bankrupt. Now he wanted to travel back to Malaysia and asked for my help.

I even explained to him the procedure to get the letter from JIM as my spouse is a bankrupt. But he wants to pay monthly like all 'our brothers & sisters' in this forum. He doesn't mind the hassle.

My doubt is whether his case will be treated the same like us. Anyone has experience in this type of case?

@Jane,

I am trying to follow your friend's footstep, migrate and give up my Malaysian citizenship as soon as I get a new passport from my new host country.

My question for your friend is, did he get his Singaporean citizenship AFTER or BEFORE he was declared a bankrupt in Malaysia?

What difference does it make?  Before and after?  How to solve the problem of going back to Malaysia?

@same problem,

Well, to you, it makes no difference, to me, it is important, I need to know if it is BEFORE or AFTER for my own reasons, obviously.

Just to share this info.

Went to Jabatan Insolvensi Malaysia (JIM) office. Official Assignee (OA) mentioned even though my friend is already a Singaporean and if he wants to travel to Malaysia, he will be stopped at Immigration. My friend will have to do the same procedure like any Malaysian who wanted to work overseas.

@Penumpang... unless you are 100% sure that you will never step back in Malaysia soil again, then go ahead to get another country citizenship.

Quite surprise to hear that you will be stopped at immigration. How about entering Malaysia for the purpose of holiday? Maybe there is another international law which prevents it... can anyone confirm?

Suggestion: Why not ask at the High Commission of Malaysia in Singapore first before coming back to Malaysia, I seriously doubt the people at the High Commission of Malaysia in Singapore would arrest your friend and extradite him/her to Malaysia, especially since being a bankrupt is not a crime or an offense.

@ccss

I meant if my friend would only be stopped at Malaysia immigration when he wants to leave. The Official Assignee (OA) mentioned something about Commonwealth Countries which he meant Malaysia & Singapore had signed some sort of agreement. No matter he is already a Singaporean but if he has court/bankruptcy cases, he/she will have to report to Malaysia Jabatan Insolvensi Malaysia (JIM) before he is allowed to leave Malaysia.

@Jane,

If that is true, that is, an ex-Malaysian using a foreign passport will be detected & stopped based on that person's name by Malaysian's immigration computer, their computer system is indeed very powerful, thanks for the heads up.
