Saya ada housing loan dgn cimb bank dimana lian at as nama saya Dan wife saya.

Baru baru ini saya dpt notis saman bangkrap Dari individu dimana saya ada pinjam suit.

Jika saya di istiarkan bangkrap boleh ka in solves I lelong rumah saya dimana hutang bank masih ada 15 tahun lagi RM 106k value rumah 100k hutang org 120k

Rumah ada dua nama. Jika nasib tak baik, kena bankrupt dan creditor itu mau wang, hanya OA/JIM bolih buat keputusan nak lelong atau tidak. Market value RM100K, creditor hanya boleh dapat 50%=Rm50K, baki wang isteri awak punya.

Awak punya case, loan masih hidup, jika betul OA/JIM lelong, wang semua pergi selesai Bank Loan. Creditor dapat $$$00000.00. Hahahaa.. Awak selamat.. bolih tinggal di rumah AND HAVE A PIECE OF MIND NOW....

Untok case awak, bank yang bagi housing loan bolih lelong rumah dalam 6 bulan, tapi untuk awak, susah untuk bank awak buat bagitu sebab bila lelong jika bawah market value, kena "shortFall" plus duit lelong.. Lebih baik bank allow you to continue instalments. Masaalah lepas 6 bulan, JIM akan take possession of the house, tapi dengan JIM awak masih bolih tinggal di rumah sampai bila JIM ingat bolih lelong rumah. Binchang dengan OA/DGI untuk langah yang win-win situation.

Q's..

1/What type of employment are you in now? Age?
2/Your wife working? Age?
3/How many children?
4/Any other dependants, eg. parents?
5/"individu" what sort of loan and for what purpose? Got legal official documents to sue you?
6/When is the bkcy case to be heard, date?
7/When did this creditor get a creditor judgement? ie, hearing for "writ of summons" in the past? Did you attend court at that time.?
8/What is the monthly housing loan repayment now till 15years later? Is it equal to rental for new place?
9/Do you like this house and still would like to live in it for the next 15yrs.

I am trying to find a solution whereby if really be made a bankrupt, and with the permission from JIM/DGI, your wife continues with instalments(like rental paying) for the next 15years. At end of 15yrs the houseownership name will be transfer to your wife ONLY. And, if you are discharged by then, your name can be inside too. I am trying for discussion purposes to merge Bankruptcy Laws and Divorce Laws (Division of Properties).. No..  i am not asking you to divorce. Merge the applications only.

i just got back from JIM

did asked about anuar condition asuming if i'm in his shoes...
the officer told me that if only my wife can maintain prompt payment and akaun cantik than is ok or else my wife can be bankrupted too... worst scenario can happen if both h/w bankrupted...

The whole story is not complete yet. Till Anuar, if he is still on the thread, replies then only things are possible or not depending on his situation.

BTW he is not make bankrupt yet. How to bankrupt her if the loan is not under her name.?? The other conditions to be met also is if JIM and the bank is willing to accomodate. A sort of "separate deed of assignment".

That means it is possible to "save" that house if they love the location. This cara boleh jalan.. What is the difference? rent$$=$$continue instalment?? Unless the monthly housing loan is very much higher..
