hello sir,
i am pakistani girl married with korean boy, we or currently here in malaysia on visiting visa,i am pragnant of 8 month 0n 24th june im going to deliver my baby,to day i got 1 month extension in visa till 20 june 2010, but i am going to deliver baby on 24 june 2010,immigration is not granting me visa  thay said pakistani can allow to stay only 2 month,tell me wut i do. my husband got visa till 20 july 2010,
and my visa finish on 20 and my delivery date is  24 how can i travell??
and if i stay here then what is my baby status?if i cannot got visa yhan can i go out of malaysia if i be illegel? guide me wut i have to do?this  time i have one month here?? waiting ur reply...

What are you and husband doing here besides visiting? You still have more than one month to prepare and get out of trouble.

Why don't you get back to where you belong to avoid such predicament?

Please note that this is my personal opinion only, I am not a lawyer or an expert. My only claim to post an opinion is because I myself have posted a query in this forum, pursuant to which I have done a lot of reading and research, picking up bits and pieces of information along the way.

Information that I have gleaned relevant to your situation is this.

Baby born in Malaysian automatically becomes a citizen ONLY IF one of the parent is a citizen OR permanent resident. There is a gray area if both parents are stateless (e.g. refugees). On a case-by-case basis, some stateless newborn have been awarded Malaysian citizenship.

Since you were awarded a tourist visa, I assume you are not stateless (since normally Embassy would require proof of citizenship/residency before approving visa). By stating “Pakistani girl”, I assume you are a Pakistani citizen (not a resident of Pakistan, or parents who are citizens) – ditto with “Korean boy”, as in husband is Korean citizen.

Since neither one of you are citizens or permanent resident of Malaysia, your soon to be born baby will not become a Malaysian citizen (assuming baby is born in Malaysia).

Closer to your delivery date, I would get a doctors note and try to get another extension from immigration. If they deny it, TECHNICALLY you have to leave by June 20. As far as I know, there is no grace period.

I say a qualified TECHNICALLY because I believe the authorities would not be so inhumane as to deport you right away, given your condition. After delivery, and you are able to travel, you have to leave. I believe the authorities will accommodate that.

But I agree with Arrow. Given the situation, you should consider leaving now to avoid complications, provided it is safe for (unborn) baby to travel.

Please be advised again that this is just my opinion, your mileage may vary. There are people here who post their respective opinions, occasionally totally incorrect, so be careful in what you read.

Raykat is right. Your baby will not be a M’sian citizen unless one of the parents is. With your husband being a Korean, I would highly recommend that you fly to Korea and have the baby born there. I believe Korean goes by blood linage with father and if your baby is born there, he will definitely be a Korean citizen.

The last thing you want to do is having your baby born in place where he/she couldn’t gain citizenship and you’ll have to go through a ton of paperwork to acquire citizenship by virtue of parents. Not to mention that both of you are of different nationality. Make a quick decision now and leave quickly.
