HELLO THIS IS A SAD STORY OF MY FRIEND WHO IS FROM INDIA,HER HUSBAND WAS WORKING FOR A COMPNAY HERE IN MALAYSIA ,THEY ARE MARRIED FOR 3 YRS,SHE HAS A KID. WHEN SHE HAD GONE TO INDIA FOR DELIVERY HER HUSBAND STARTED A RELATIONSH WITH A MUSLIM GIRL WHO IS A DIVORCEE AND HAS TWO KIDS.LATER MY FRIEND CAME TO KNOW THAT HER HUSBAND HAS ALSO DONE THE SUNAT OPERATION.MY FRIEND AND HER HUSBAND ARE INDIAN CITIZENS.ANOTHER THING IN THIS IS HER HUSBAND WAS THERE IN MSIA FOR 5 YEARS ON WORK PERMIT THIS YEAR HIS COMPANY HAD TERMINATED HIS WORK PERMIT SAYING THIS IS HIS COOLING PERIOD.I JUST WANT TO KNOW :

1)IS IT POSSIBLE FOR HIM TO MARRY THE MUSLIM LADY LEGALLY WITHOUT DIVORCING HIS FIRST WIFE AND ALSO NOT CONVERTING TO ISLAM?
2)IS IT POSSIBLE FOR HIM TO GET A PR?
3)EVEN THOUGH THIS IS COOLING PERIOD AT PRESENT HE IS IN MALAYSIA ON A TOURIST VISA,SOME SAY SAY U CANT ENTER MSIA FOR 6 MONTHS IS IT SO?
4)WHEN A PERSON IS IN COOLING PERIOD CAN HE APPLY FOR JOBS IN MALAYSIA?
5)FOR HOW MANY MONTHS CAN HE STAY IN MSIA UNDER TOURIST VISA?
6)SUPPOSE IF HE MARRIES THIS LADY CAN HE GET A JOB IN MALAYSIS
7)WAT R THE RULES FOR A MUSLIM DIVORCEE MARRYING A NON MUSLIM

PLS ANY ONE HELP ME IN THIS ISSUE ITS VERY URGENT

You raise a number of issues and appear to be shouting (internet etiquette requires you to turn off the Caps Lock when writing my friend). Putting that aside you appear to believe Indian and Muslim are two separate races. Are we to understand your friend is Hindu. Remember there are 180 million Muslims in India none to my knowledge are Malays.

So back to your problem again, why is it sad. The man is quite obviously happy. His wife may not be so and you are seeking to obtain information on her behalf. His application in respect of his work affairs are from now on his. He may apply to the department of immigration and even where the circumstances are rather out of the ordinary, there are provisions for immigration to allow him to stay a little longer or the minister to apply his discretion to ewxtend his visa because he now has the children and wife of his new marriage to care for. It would be an inhumane thing to do to them if he were asked to leave Malaysia. Local support (community ) groups could intervene and help him to have his visa extended as well by offering support and the minister wold use his discretion to extend his stay.

As for his now estranged 'Indian' (meaning Hindu) wife, she has two choices. One to issue proceedings and seek interim orders against him and to put a caveat on all his property in Malaysia and in India. Go to a better website where lawyers will provide real support:www.law-on-order.com

His marriage to the Muslim woman ( if thats what happened) could well be something that is not recognised and annuled or extinguished upon embracing Islam. It is one of those things. He could well raise the defence that he married her by reciting "Talaq, Talaq, Talaq" (Divorce thrice) thereby giving effect to the Islamic procedure for divorce in the Sunnah (as opposed to his Sunni which he has already cut a part off  with the sunat).

Sepcifically what is your message?
if you want specific answers to each unconnected or vaguely connected questions then let me put it this way to you:

1) He can marry anyone legally without being divorced legally. But the consequences if you are not Muslim is that you can be charged with Bigamy. Marrying a Muslim woman, requires you to convert first which I presume he did. Then marrying conforms to the accepted practice of polygamy of being able to legally marry 4 wives in Islamic traditions. Once a Muslim, your previous status as married is invalidated if you opt for Shariah. In Malaysia there is some discrepancy as to the operation and the practical application of this aspect of the law with interracial and inter faith marriages. I won't give specifics but two sultans at least did he same and were not brought to task on the matter nor were their spouses. There have been numerous other cases but thats an acadfemic point now.

2)It is possible for him to get a PR providing he meets the requirements for the grant of a PR. In fact it is more likely now that he has accepted the faith and plans to marry (I presume)an indigenous Malay thereby by law revoking his past identity. They are de facto maried now from wht you are saying.

3)That may be the case but the facts speak differently. He is in Malaysia. Thats what I meant yesterday by intervention and ministerial discretion.

4) Depends on whether the is given dispensation from the normal requirmements. In circumstances of extreme hardship he may be able to apply and receive this dispensation. On other occassions the facts are the department may not be aware of his working. Generally it would be  a breach of international law and international labour law if he is made redundant during a 'cooling period' after so many years then not be allowed to support himself.

5)Again depends on the passport he holds. Malaysia and India have changed their rules of entry and work requirements for their respective citizens of late. A typical tourist visa is valid for 6 months subject to the applicaiton and grant of a different on shore visa.These are both commonwealth countries.

6) If he marries this Muslim woman his fortunes will change rapidly.

7) a Muslim anyone, divorcee or otherwise may marry a non Muslim unless of course you are talking about Arabs and Malays. They practice a strange form of chauvanism related to religion which deems a Muslim may not marry another if the other is not Muslim. In Malaysia he must convert or his life will be hell on earth.
