Misdiagnosed by Skin Specialist - Rxxxxx Sxxxx

I was misdiagnosed by the famous skin specialist Rxxxxx Sxxxx in 2010, I went to Members of Parliament (MP) of Kelana Jaya who then issued a letter of invitation to him but he dare dare ignored, now I have engaged a lawyer whom has issued him a Notice of Demand.

The Notice of Demand reads:

We act for ~my name~

We are instructed that 12 Dec 2009, our client visited your clinic and she was diagnosed with Eczema.  On 20 October 2010 you gave her a topical steroids injection to her left hand.  A month later her condition become worse.

One 22 Dec 2010, our client visited Sunway Medical Centre and her skin biopsy confirmed Psoriasis which is know to be exacerbated by oral steroids.

Our client suffered chronic skin disease namely psoriasis causing itchy and painful scaly red large rash all over the body. This affected her joints as well and caused difficulty in her work and she needed to take time off from her work frequently.

As a result from that, our client is:-
(a) diagnosed to have depression;
(b) Lost her work due to her condition of red large rash over the body;
(c) Gained weight rapidly (almost 20kg in a year) due to oral steroids;
(d) spent money seeing psychiatrists; and
(e) spent about RM60,000 at a slimming centre.

We are further instructed that negotiations were held to resolve amicably the issue of misdiagnosed out of court at the office of YB ~ without success.

We have been instructed by our client to demand from you, which we herebydo, the medical expenses spend by our client and also lost of job.

Kindly revert to us within 14 days hereof failing which we have firm instructions to seek legal redress in court.

I will post the reply from Rxxxxx Sxxxx's lawyer later, which basically denied all claims.

Anyone here know any good Medical Negligence lawyer? And anyone here had an experience of suing a specialist?
Before I post the reply from Rxxxxx Sxxxx's lawyer (which is quite long), I am just wondering, can the defendant's lawyer obtain my medical record without my consent?

That's the famous Klinik Pakar Kulit Rxxxxx in SSXX right?

I have heard of his arrogant and careless attitude, I have got 2 friends who went to him only to find their conditions worst, they wanted to sue him too, but they said they don't think he cares about that as he is filthy rich and they are tons of unfortunate and blinded people still going there.

Your lawyer is Kxxxxxx from Seremban right? I think you are in good hands.

The Letter of Demand seems to be too short, simple and not compelling enough for a medico-legal case.
Perhaps they do not have much experience in this area, or perhaps a young lawyer prepared it.

Post that skin doc reply. See what he says. Your Letter of Demand (LOD) is very weak. Since the skin doc is so famous, he could have had already a very rich and experienced lawyer. Post and see if more heads is better than one. A pack of wolves can also kill!

You are sueing me. If I dont reveal your medical condition, how could I defend myself.? There are a lot of questions to ask you, even personal ones? The fight is on his screening process, whether conducted professionally and systematically, then only the negligence part can stick. OR ELSE waste monies to SUE.!! The doctors at the private hospital is not going to be of any use at all.

There are TWO letters from MP to Rxxxxx Sxxxx actually.
The first letter was open-dated because MP can't commit to a fixed date.

The 1st letter from the helpful Kelana Jaya MP reads:

Since then, the patient has suffered spiraling negative side effects of the medication prescribed by you and it has affected a big part of her life, physically and mentally.

3. As the Member of Parliament of the Kelana Jaya constituency, it is my duty to help my constituents in resolving issues and difficulties they face. My approach is to first seek an amicable settlement. I therefore wish to extend an invitation to you to have a meeting with the patient in hopes of settling this issue amicably.
