WHAT IS AN EMPLOYMENT PASS ?

An Employment Pass is a document issued to a foreigner who wishes to enter Malaysia in order to take up employment under

  • a contract of service with
    • the Government of Malaysia or
    • the Government of any State in Malaysia or
    • any City Council or Municipality in Malaysia

or

  • a contract
    • for a minimum period of 2 years employment in Malaysia with a company or firm approved for the purpose and
    • under which such person is entitled to a salary of not less than RM$1,200.00 per month.

However, a person wishing to take up employment in the state of Sabah, must apply for Work Pass and not Employment Pass.

WHAT IS A WORK PASS AND THE CONDITIONS TO APPLY FOR IT ?

A Work Pass is a document issued to any person who wishes to enter Sabah in order to take up work or employment in the state of Sabah and that

  • such person is qualified to work or undertake employment in the trade, business or calling in respect of which the application is made and
  • there is not already unemployment in Sabah and persons skilled in that class of trade, business or calling and
  • such person taking up such work or employment will be to the benefit generally of Sabah.

For employment or work in Sabah, a Work Pass will be issued instead of an Employment Pass.

A Work Pass shall authorize the holder to enter Sabah within the period stated in the pass and to remain therein for the purpose of working or engaging in employment in Sabah as specified in the pass for such period not exceeding 5 years.

The Work Pass may specify the employer or proposed employer by whom such person may only be employed.

The employer of the holder of the Work Pass must inform the Immigration Department of Malaysia if the holder :

  • fails to take up the employment or
  • is discharged from, or leave the employment.

Your application for a Work Pass may then be submitted together with the following documents :

  • Covering letter
  • Form 17 Immigration Regulations 1963 Regulation 16(6)
  • A copy of Employment contract
  • 3 recent photographs of applicant measuring 3.5cm x 5.0cm
  • Photostat copy of Passport or Travel Document
  • Other supporting documents (if applicable)

Your application for Work Pass must be submitted by your employer in Malaysia to the Immigration Department of Malaysia.
